Ward was out of his car when Stewart fish-tailed his car into him, knocking him into the air. Stewart’s racing team manager Greg Zipadelli said Stewart will not race in NASCAR’s event Sunday at Watkins Glen.

CANANDAIGUA, N.Y. – NASCAR Driver Tony Stewart struck and killed a sprint car Driver who had climbed from his car and was on the track trying to confront Stewart During a race in upstate New York on Saturday night.
Ontario County Sheriff Philip Povero said his department’s investigation is not criminal and that Stewart was "fully cooperative" and appeared "very upset" over what had happened.
"He was visibly shaken by this accident," Povero said.

Stewart had planned to race Sunday at Watkins Glen, but his racing team announced Sunday morning that the 43-year-old would not drive in the event.
"We feel strongly that this is the right thing to do,"Stewart’s racing team manager Greg Zipadelli said, calling Ward Jr.’s death "an unbelieveable tragedy."
"He’s going through a tough time," Zipadelli said of Stewart. "It’s emotional for him. We as a group support him. We feel like he’s doing the right thing."
NASCAR supported Stewart’s decision and said that it would monitor the situation as the investigation continues. In a statement, NASCAR said that the organization’s "thoughts and prayers go out to the family, friends and fellow competitors of Kevin Ward Jr."
Initially, Zipadelli said Stewart will race in the NASCAR event, calling the race "business as usual."

A video of the crash at Canandaigua Motorsports Park showed Driver Kevin Ward Jr., wearing a black helmet and firesuit on a dimly lit track, walking toward Stewart’s car before being hit and hurtled 50 feet.
Povero said the 25-lap race was under caution when Ward was struck. Stewart’s car was behind another before he hit Ward.
"The first car swerved to avoid the driver," Povero said.
Povero said the Driver was pronounced dead Saturday night at a Canandaigua hospital. Stewart was unhurt.

Dad acquitted in slaying of driver who killed sons

ANGLETON, Texas (AP) — A southeast Texas man says that despite his acquittal Wednesday for the shooting death of the drunken driver who caused a crash that killed his two sons, there are no winners.

"This was a loss for every****," said a visibly relieved David Barajas, who cried and hugged his wife, Cindy, after the verdict was read.

Prosecutors had alleged that Barajas killed 20-year-old Jose Banda in a fit of rage after Banda plowed into Barajas and his sons while they were pushing a truck on a rural Southeast Texas road near their home because it had run out of gas. Twelve-year-old David Jr. and 11-year-old Caleb were killed.

Authorities said that after the accident, Barajas, 32, went to his home about 100 yards from the crash site near Alvin, got a gun and returned to shoot Banda.

Defense attorney Sam Cammack said Barajas didn’t kill Banda and that he was only focused on saving his sons. The gun used to kill Banda wasn’t found and there was little physical evidence linking Barajas to the killing.

The jury deliberated for about three hours Wednesday before acquitting Barajas of murder.

After the verdict, Brazoria County District Attorney Jeri Yenne insisted that investigators had correctly zeroed in on Barajas and that the actual killer wasn’t still at large, as Cammack had suggested at trial.

"What the state’s perspective is and will always be is that if you or I or anyone we know had a horrible collision and killed another human being, that you get the fair review of the criminal justice system, not a roadside execution," Yenne told reporters.

Banda could have been sentenced to up to life in prison, if he had been convicted.

Legal experts said prosecutors also likely had to overcome jury sympathy for Barajas, who had the support of many residents of Alvin, which is about 30 miles southeast of Houston. Further complicating their case was that there were no witnesses who identified Barajas as the shooter, and gunshot residue tests done on Barajas came back negative.

While both sides differed on who might have been responsible for Banda’s death, they agreed that this was a tragedy for everyone involved.

"Three sons were lost that day. The state has compassion for every single one of them, the Barajas children and the Banda son," Yenne said.

Barajas said he is hoping to move forward and get closure with regard to his sons’ deaths. But he also said that he is praying for Banda’s family.

"They lost a son, too," Barajas said.

Banda’s family did not speak with reporters after the verdict. Felicia Leija, Banda’s common-law wife, did not immediately return a phone call seeking comment.

During the trial, investigators testified that a bullet fragment found in Banda’s car could have come from a .357-caliber gun, and that ammunition for such a gun was found in Barajas’ home.

A forensic scientist testified blood found on the driver’s side door and driver’s arm rest of Banda’s car was consistent with that of Barajas.

Cammack spent most of his closing argument earlier Wednesday trying to knock down the prosecution’s evidence. He said tests showed the bullet fragment found in Banda’s car could have also come from another weapon besides a .357-caliber gun. He said the blood found on Banda’s car that came from Barajas was spilled when Barajas was attacked by Banda’s cousin and half brother, who witnessed the crash but later told investigators they fled the scene.

Cammack also suggested that Banda’s cousin or half brother could have been responsible for the shooting. Banda’s cousin and half brother testified they did not shoot Banda. Cammack also told jurors that a search of Barajas’ home failed to find any evidence that directly linked him to the crime scene.

The defense attorney also used 911 calls to create a timeline that suggested Barajas would not have had enough time to shoot Banda.

Only three defense witnesses were called during the trial, which lasted a little over a week.

Minnie Driver: Parents Who Put Kids in Showbiz Are "Desperate and Conflicted"

Not a stage mom! Minnie Driver told Us Weekly at the Hollywood junket for her new movie, Beyond the Lights, on Tuesday, Oct. 21, that she is not an advocate of child actors in the industry.
"I’m not really for the whole Kids in show business thing," the mother of one, 44, said. The actress, who plays a nasty Hollywood momager in the film, told reporters that even moreso, she’s felt uncomfortable with the Parents of these young Kids in the spotlight.

"It’s really difficult even when you meet lovely Parents of children who are in show business," admitted Driver, who also works closely with a child actor on the set of her NBC sitcom About a Boy. "There is still the fact that they’re not having a childhood. They are out of their element, and in the element of an adult world which is not always appropriate. It seems to me there is always a certain level of desperation that makes a person put a child in that position."

Driver, a mom to her 6-year-old son Henry, tried to draw the character profile of a stage parent. "That’s an interesting place to start for a character: Someone who’s desperate and conflicted," she said. "And if that’s overshadowing everything else, it doesn’t matter how nice or kind or empathetic they may be elsewhere. The overriding thing is quite fierce."
The Good Will Hunting star said it really was a clash ("an interesting seesaw") between wills. "You love them, of course you love them, but you want this other thing," she reasoned. "It’s the realm of the hungry ghosts. That’s really interesting for an actor."

Meanwhile, the Oscar-nominated actress claimed that her character is not a villain. "You can’t be a villain. Villains aren’t interesting unless there is the un-villainous part of them," she explained. "You really understand why she does what she does… You really get it. It’s not from a malicious point of view. She’s not a sociopath, she’s not evil. She just desperately did not want to go back to that poverty and she wanted something better for her kid."
